These Terms and Conditions govern the use of our products and services by individual customers. By registering with Remit Circle and using our services â including transferring funds to friends, family, or businesses â you enter into a legally binding agreement that outlines both your rights and our responsibilities.
1. About this Terms and Conditions
1.1 This Terms and Conditions is made between you, the individual user (âyouâ), and Hax Capital Pty Ltd, operating under the name Remit Circle (âRemit Circleâ, âweâ, or âusâ). It sets out the terms and conditions (âTermsâ) under which we provide our services to you. Your use of our services is also subject to our Privacy Policy, which outlines how your personal information is collected, used, and safeguarded.
1.2Â By accessing or using our Services, you acknowledge that you have read, understood, and agreed to the most recent version of these Terms as published on our Website, App, or through an API Partner. If you do not accept these Terms, you must not use our Services.
1.3Â If there is any inconsistency between these Terms, our Privacy Policy, or any other information provided on our Website, App, or by an API Partner, these Terms will prevail.
1.4 Application of These Terms: If you use our Services for money transfers, you are deemed to have accepted these Terms each time you initiate a transfer.
1.5 Future Updates: We may revise these Terms periodically, as outlined in the section âOur Right to Make Changes.â Any updates will become effective either immediately upon being published on our Website or App, or from the date we notify you.
1.6Â The latest version of these Terms is always available on our website. If you wish to keep a copy, you may download it at any time.
2. Defined words in this Terms
2.1Â In these Terms, capitalised terms are either defined in brackets throughout the document or carry the meanings provided in the definitions section below:
- API refers to the application programming interface made available by Remit Circle, including those accessed via an API Partner.
- API Partner refers to a third-party business we collaborate with, allowing Remit Circle to deliver our Services through their website, mobile app, or similar platforms
- App refers to our mobile application, including the software itself, any data provided with it, and related media content.
- Business Day means a day other than a Saturday, Sunday, or a public holiday in Australia when financial institutions in Melbourne, AU are open for business.
- Chargeback means a reversal of a payment to you that occurs when the sender disputes the transactions with their bank or payment provider â claiming it was made without authorization â or if the original payment to Remit Circle fails for any reason, such as insufficient funds, a closed account, or other payment issues.
- Intellectual Property includes all legal rights we hold over things like our trademarks, logos, content, software, designs, and inventions. It also covers any registrations or protections we have around the world, as well as our confidential information, trade secrets, and technical know-how. These rights allow us to control how our materials are used and protect us from misuse or copying.
- Money Transfer refers to the process where you send funds through Remit Circle to a specific person or recipient of your choice.
- Reversal refers to a situation where money you received in taken back, refunded, or withdrawn for any reason â such as if the original payment failed due to insufficient funds or the account closure.
- Services include everything we offer, such as our products, features, technologies, and content â whether through our website, mobile app, or API partners. This also covers your Remit Circle account, currency conversion tools, and money transfer services.
- Website means any Remit Circle webpage, including www.remit-circle.com, where we provide the Services to you.
- Remit Circle Account means an account held by customers at Remit Circle
3. Who Can Use Our Services?
3.1 You must be an individual and at least 18 years old to use our Services.
3.2 You are permitted to have only one Remit Circle Account and a single user profile.
3.3 You are responsible for all actions taken under your Remit Circle Account or profile. By using our Services, you agree to transact solely for yourself â not for anyone else. You must not permit anyone else to access your account or use the Services on your behalf.
4. Starting Your Journey
4.1 To use our Services, you will need to set up a profile and provide the information we request during the registration process.
4.2 You must ensure that all information you give us is complete, accurate, and truthful always. If anything changes, it is your responsibility to update it promptly. We are not liable for any losses caused by your failure to do so. We may also request that you verify your details or provide additional documents whenever needed.
4.3 To comply with legal and regulatory requirements, we may carry out identity verification, security screening, and other due diligence checks before allowing access to certain Services. This may include collecting personal identification, verifying source of funds, and ongoing monitoring of your account activity. You agree to cooperate fully and provide any information or documents we reasonably request. We may suspend or limit your access to the Services if these checks are not completed or if we have concerns about the legitimacy of your activity.
4.4 You agree to provide any additional information we request. You also allow us to verify the information you have given by making inquiries ourselves or through trusted third parties. This may include checks using commercial databases or accessing your credit report. You authorise us to obtain your credit report at any time to assess, manage, or update your Remit Circle Account, or if there is a dispute related to these Terms or our Services. To do this, we may share necessary details such as your name, address and date of birth with a credit reporting agency.
4.5Â If we are unable to obtain or verify information about you or your transaction, Remit Circle may suspend, restrict, or close your account, or limit your access to our Services.
5. Staying Safe While Using Our Services
5.1Â Your safety matters to us. While we work hard to protect your information and secure your account, it is also important that you take steps to stay safe when using Remit Circle.
5.2Â To help protect your account:
- Keep your login details, passwords, and verification codes confidential.
- Never share your account with anyone â even people you trust.
- Only use our official website, app, or trusted partners to access our services. Emails and SMS messages sent by fraudsters may lead to fake login portals that could phish your login information and 2-step authentication details. Similarly, criminals can place malicious adverts on search engines that lead to fake websites of trusted businesses, including Remit Circle.
- Keep your devices and software up to date and avoid logging in from public or shared computers.
- Install and maintain the latest anti-virus software on your device, where applicable.
- If you suspect you have become a victim of a scam, contact our Customer Support.
5.3Â If you believe your account has been compromised or notice any suspicious activity, you must contact us immediately. Delays in notifying us may impact our ability to protect your account and may result in losses which we are not responsible for.
5.4Â Please note that Remit Circle is not liable for any loss caused by your negligence, including if you fail to take reasonable steps to protect your login details or allow someone else to use your account.
5.5Â While we do our best to provide a safe and reliable service, we cannot guarantee that our website or app will always be free from errors, bugs or viruses. You should use appropriate security software and precautions when accessing our services online.
6. Conditions on Service Usage
6.1 Personal Use Only. This Remit Circle Account is for individual use only. You may not use our Services for business purposes or as a business account. If you require services for commercial activity, please contact us to apply for a Business Account.
6.2 Responsible Use: you must use our Services in a lawful and respectful manner. You agree not to:
- Violate any laws or regulations.
- Provide false, misleading, or incomplete information.
- Use the Services to send or receive funds linked to fraud or illegal activity.
- Harass, abuse, or threaten our staff or other users.
6.3 System Integrity: You must not:
- Disrupt, damage, or interfere with our Website, App, API, or systems.
- Upload or distribute malware, viruses, or harmful code.
- Attempt to gain unauthorised access to our systems or the accounts of others.
- Use bots, scrapers, or other automated tools to interact with our platform without permission.
6.4 Prohibited Behaviour: You must not use Remit Circle for any illegal or harmful activity, including:
- Money laundering, terrorist financing, or breaching applicable financial crime or anti-bribery laws.
- Violating international sanctions, including dealings with sanctioned individuals, entities, or countries.
- Receiving or sending funds we reasonably suspect to be fraudulent or criminal in origin.
- Circumvent account restrictions, suspensions, or decisions made by Remit Circle.
- Use someone elseâs identity or account information.
- Open multiple accounts by bypass limits or avoid penalties.
- Abuse chargeback or dispute processes.
6.5Â Breach Consequences: If we believe you have breached these conditions or pose a risk to the integrity of our Services, we may act at our sole discretion, including:
- Suspending or permanently closing your account.
- Restricting your access to certain features, including the ability to send or receive funds.
- Delaying, blocking, or reversing any transaction we reasonably believe may violate the law, our Terms, or third-party rules.
- Holding funds to manage risk or comply with legal requirements.
Notifying affected third parties, including your bank, payment provider, or relevant authoritie
6.6 Legal Compliance and Court Orders: If we receive a court order, regulatory instruction, or similar legal process involving you or your account, we may take appropriate actions such as freezing funds, limiting access, or releasing funds, as required. Where permitted, we will notify you using the contact details you have provided. We are not obligated to dispute or contest such orders.
7. Ending or Suspending Your Access to Remit Circle
7.1 Closing Your Account (Your Choice): You may request to close your Remit Circle Account at any time by contacting our support team. Before we can process your request:
- All transactions must be completed or cancelled.
- Any remaining balance must be withdrawn or transferred.
- We may ask you to verify your identity or provide additional information.
7.2 Suspending or Closing Your Account (Our Decision): We may suspend, restrict, or permanently close your account at any time, with or without prior notice, if:
- You breach these Terms or our Privacy Policy.
- We detect unauthorised, suspicious, or fraudulent activity.
- You violate any applicable laws or regulations.
- Your account has been inactive for a prolonged period.
- We are required to do so by a court, law enforcement, or regulator (including AUSTRAC or ASIC)
- We reasonably believe that continuing to provide you with Services may expose us or others to risk, harm, or liability.
7.3 After Your Account is Closed or Suspended: Once your account is closed or suspended:
- You will no longer be able to use our Services or access your profile.
- Any balance remaining in your account may be returned to you (unless subject to legal hold or regulatory obligation).
- We may retain your transaction history and personal data for up to seven years (or longer if required by law), in line with our legal, tax, and anti-money laundering obligations.
- You remain responsible for any obligations or liabilities connected to your past use of our Services, even after account closure.
7.4 When you may not close your Remit Circle Account or delete your profile. You must not close your Remit Circle Account or delete your profile to evade an investigation (either by Remit Circle or an enforcement agency) or if you have a pending transaction or an open dispute or claim. If you attempt to do this, we may hold your money for a period that is reasonably necessary to protect our or a third partyâs interest.
7.5Â We may prevent your account from being closed or delete your profile if you have a negative balance or if your Remit Circle Account is subject to a hold, limitation, or reserve.
7.6 Refunds After Closure. If you are entitled to a refund at the time of closure, we will process the return of funds using your last known payment method. We may request updated bank details to complete the refund. Processing times may vary depending on the methods and receiving institution.
7.7 Reactivation of Accounts. You may ask to reopen a previously closed account. We are not obligated to approve such requests and may refuse to reactivate accounts for compliance or risk-related reasons. We may also request additional verification before considering your application.
8. Our Pricing
8.1Â Registering for Remit Circle and/or opening a personal Remit Circle Account is free. You may incur a fee when you use parts of our Services such as sending money and converting currencies.
8.2 You must pay our fees. We may not process your transaction(s) or provide any other Services to you until we have received the fees from you. Our fees do not include any fees that an API Partner, your bank, the recipientâs bank or other third party may separately charge.
8.3 Taxes. You are responsible for any taxes which may be due by you because of your use of our Services, and it is your responsibility to collect, report and pay the correct tax to the appropriate tax authority.
Money Transfers
9. Sending money
9.1 Information you need to provide to set up a Money Transfer. To initiate a Money Transfer, you must provide us with specific details, including but not limited to:
- The full name of your recipient,
- Your recipientâs bank account information, and
- The amount and currency you wish to send.
We may request additional information if required to complete the transfer or meet our legal and compliance obligations.
9.2Â To make a Money Transfer, you must sign in to your Remit Circle Account and follow all required authentication steps, including entering your password and any verification prompts. By successfully completing these steps, you are deemed to have given your consent for us to proceed with the Money Transfer on your behalf.
9.3 Payment limits and Applicable Terms. We may impose limits on the amount you are permitted to send per Money Transfer, either on a per-transaction basis or over a set period (e.g., daily, weekly, or monthly). These limits may vary based on your verification status, destination country, currency, payment method, or transaction history. When you initiate a Money Transfer, you may be transacting with a different Remit Circle group entity depending on the currency involved or the recipientâs location. That transaction will be governed by the customer agreement of the applicable Remit Circle entity, which you agree to be bound by for that specific transfer. We will inform you of any applicable limits or relevant terms before you confirm the transaction.
10. Funding Your Money Transfer
10.1 How to Make a Payment. To pay for your Money Transfer, you must log in to your Remit Circle Account via our Website or app and follow the steps provided to complete your order.
10.2 Payment methods. You may be offered on or more payment methods depending on factors such as your location, the currency being sent, and your verification status. Please note that:
- The availability of a payment method is not guaranteed.
- We may change, restrict, or discontinue any payment method at our discretion and without notice.
10.3 Payment instruments must be in your name. All payment instruments (e.g., bank accounts) used to fund a Money Transfer must be in your name. We do not accept third-party payments.
10.4 Providing sufficient funds. We must receive full, cleared funds before we can process your Money Transfer.
- You are responsible for ensuring that payment is made promptly after submitting your transfer request.
- We are not liable for any delays or losses caused by your bank or payment provider in sending funds to us.
- If you send funds before completing your transfer instructions, we will hold the funds in your Remit Circle Account.
11. Transaction Processing and Timing
11.1 When we will complete your Money Transfer. Once we receive your payment and all required information, we will begin processing your Money Transfer in accordance with your instructions.
We may delay or refuse to process a transfer if:
- We have not received sufficient cleared funds.
- Your instructions are incomplete, inaccurate, or unclear.
- We reasonably suspect the transaction may involve fraud, unauthorised use, or breach of law or our Terms.
Processing times may vary depending on factors such as the destination country, currency, payment method, and time of day. While we aim to complete transfers promptly, we do not guarantee specific delivery times and are not liable for delays caused by third-party banks or payment service providers.
11.2 The Remit Circle exchange rates. We will confirm the available exchange rate (if applicable) for your Money Transfer:
- (a) when you place your Money Transfer, if it is a guaranteed rate Money Transfer; or
- (b) when we have received your payment, if it is a non-guaranteed rate Money Transfer.
11.3 When we receive your request. If your Money Transfer request is received by us after 5pm AU time on a Business Day or on a day that is not a Business Day (e.g., a weekend or bank holiday), your Money Transfer will be deemed received on the following Business Day.
11.4 What happens after you have submitted your Money Transfer request. Once we have received your Money Transfer request, we will provide you with a unique transaction number which you can find in your Remit Circle Account or profile. You should quote this number when communicating with us about a particular Money Transfer or other transaction.
11.5 Completion time of your Money Transfer. The estimated completion time of your Money Transfer will be provided to you when setting up your Money Transfer.
11.6 We will use reasonable efforts to ensure funds arrive at your recipientâs account within the timeframe provided. We will make reasonable efforts to ensure that your funds reach the recipientâs bank or payment account within the estimated timeframe communicated to you at the time of the transaction. However, please note that we do not control how quickly the recipientâs bank or payment service provider credits and makes the funds available. Processing times on the receiving end may vary due to banking hours, local regulations, or other factors outside of our control.
11.7 Accuracy of information you provide. You are responsible for ensuring that all information you provide when setting up a Money Transfer is complete and accurate â including the recipientâs details and payment instructions. If we process your transaction based on the information you provided, it will be considered correctly completed, even if you made an error (such as entering the wrong recipient details or account number). We are not liable for any loss resulting from incorrect or incomplete information that you submit.
11.8 If you provide incorrect information. If you give us incorrect details when setting up a Money Transfer â such as the wrong account number or recipient information â we may attempt to help you recover the funds. However, we are not obligated to do so, and we cannot guarantee that recovery efforts will be successful. Remit Circle is generally unable to verify whether the recipientâs name matches the account number you provided, as that information is not always accessible to us.
11.9 Finality. When you make a Money Transfer, the settlement and payout to the recipient are final and irrevocable unless otherwise provided in this Terms or pursuant to applicable law.
USE OF REMIT CIRCLE CONTENT AND BRANDING
12. Intellectual Property and Usage Rights
12.1Â All content, trademarks, logos, software, designs, and material provided through the Remit Circle Website, App, or Services (collectively, âRemit Circle Materialsâ) are owned by Remit Circle or licensed to us and are protected by intellectual property laws. You are permitted to use the Remit Circle Materials solely for the purpose of accessing and using our Services as intended. You may not copy, reproduce, modify, distribute, or otherwise use any of our content without our prior written permission.
You also agree not to:
- (a) use any of the Remit Circle Materials for any commercial purpose
- (b) use any of our branding or trademarks in a way that could confuse or mislead others
- (c) remove or alter any copyright, trademark, or other proprietary notices contained in our materials
- (d) create derivative works or reverse-engineer our platform or software.
Nothing in these Terms grants you ownership or rights to use our intellectual property except as expressly stated.

We will inform you of any applicable limits or relevant terms before you confirm the transaction.
13. Remit Circle App
13.1 The Remit Circle App is our official mobile application that allows you to access and use our Services on compatible devices. By downloading and using the App, you agree to:
- Use it only for lawful purposes and in accordance with these Terms.
- Keep your login credentials secure and not share them with others.
- Ensure your device is secure and not compromised by viruses, malware, or unauthorised access.
You must not:
- Modify, copy, reverse-engineer, or create derivative works based on the App.
- Attempt to gain unauthorised access to any part of the App or its underlying systems.
- Use the App in any way that could damage, disable, or impair our Services.
13.2 We reserve the right to update, suspend, or discontinue the App (or any part of it) at any time. We are not responsible for any losses or issues arising from your failure to use the most recent version of the App or from third-party app store availability.
13.3 Your use of the App may also be subject to the terms and conditions of the app store or platform from which it was downloaded.
14. Third Party Materials
14.1Â Our Services, Website, or App may include links to, or display content provided by, third parties (including service providers, external websites, or software integrations) (âThird Party Materialsâ).
14.2Â We do not control or endorse these Third Party Materials and are not responsible for their content, accuracy, legality, or availability. Accessing or using third-party content or services is at your own risk and subject to the terms and privacy policies of those third parties.
14.3Â We make no warranties or representations about any third-party products, services, or content accessed through our platform. Any transactions or interactions you have with third parties are solely between you and the relevant third party.
OTHER IMPORTANT TERMS
15. Our responsibility for loss or damage
15.1 When we are liable. We are responsible for providing our Services with due care and skill, and nothing in these Terms excludes any rights or guarantees you may have under the Australian Consumer law (ACL) that cannot be lawfully excluded.
15.2 When we are not liable. To the extent permitted by law, we are not responsible for any loss or damage that:
- Is not foreseeable at the time you agreed to these Terms.
- Results from your use of the Services for commercial or business purposes, including loss of profits, opportunity, goodwill, or business interruption.
- Arises from events beyond our control, including system outages, natural disasters, communication failures, or other force majeure circumstances,
- Is caused by your own negligence, breach of these Terms, or misuse of the Services.
- Is caused by viruses, cyberattacks, or other malicious mode introduced via your device or external websites.
15.3 Unauthorised transactions. If you notify us of an unauthorised transaction, we will refund the transaction amount and any fees, unless we believe:
- You acted fraudulently.
- You deliberately or negligently compromised your Remit Circle Account or failed to secure your login details.
- You delayed notifying us after becoming aware of the unauthorised activity.
- You failed to inform us of the transaction within 30 days of its occurrence.
If you should reasonably have been aware that your account or credentials were lost, stolen, or misused, you may be liable for the first AUD 150 of any unauthorised transaction.
15.4 Monitoring your account. You are responsible for checking your account regularly and notifying us promptly if you detect suspicious or unauthorised activity. Delays in reporting may affect our ability to assist and may increase your liability.
15.5 Third party content and linked sites. We are not responsible for any third-party content or services accessed through our Website, App, or API. Use of such materials is at your own risk.
15.6 No guarantee of continuous service. We aim to provide reliable access to our Services but do not guarantee that they will always be available, uninterrupted, or free from bugs or viruses. We may suspend or modify the Services at any time without notice.
15.7Â Recovery of losses and outstanding amounts. If you owe us money (for example, due to a failed transaction or reversal), we may deduct that amount from your Remit Circle Account. If your account has insufficient funds, you agree to repay the balance on demand. We may also recover the debt through other means, including legal action or debt recovery agents, and you may be responsible for related enforcement costs.
15.8 Release of claims in disputes. If you have a dispute with another user or a third party you transact with, you release Remit Circle from any claims or damages arising from that dispute.
15.9 Disclaimer of warranties. Our Services are provided âas isâ and âas availableâ. To the fullest extent permitted by law, we make no warranties, express or implied, about the reliability, suitability, or availability of our Services, including warranties of merchantability or fitness for a particular purpose.
16. Updates to These Terms.
16.1 We may revise, update, or modify these Terms from time to time to reflect changes in:
- Our Services;
- Our business operations;
- Applicable laws or regulatory requirements; or
- Security, technical or operational needs.
16.2 We will post the updated Terms on our Website and App and update the âLast Updatedâ date at the top of the document. In some cases, we may also notify you by email, in-app notification, or other appropriate means.
Any changes will take effect either:
- Immediately upon being published, for minor or non-material changes (such as clarifications or formatting); or
- On the date specified in the notice we provide to you, if the changes are material or could significantly affect your rights or obligations.
By continuing to use our Services after the effective date of any changes, you agree to be bound by the updated Terms. If you do not agree with the revised Terms, you should stop using our Services and close your Remit Circle Account.

18. General Provisions
18.1 Entire Agreement. These Terms, along with our Privacy Policy and any other legal notices or additional terms provided to you in connection with the Services, constitute the entire agreement between you and Remit Circle regarding your use of the Services. They replace any prior agreements or understandings (whether oral or written) relating to the subject matter.
18.2 No Waiver. If we do not enforce any part of these Terms at any time, it does not mean we give up our right to do so later. Any waiver must be in writing to be valid.
18.3 Severability. If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
18.4 Assignment. You may not transfer or assign any of your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms, or any of our rights or obligations, at any time without notice, including in connection with a merger, acquisition, or sale of assets.
18.5 Relationship of Parties. Nothing in these Terms creates any agency, partnership, or joint venture between you and Remit Circle. You agree that you are acting on your own behalf and not on behalf of any other person or entity.
18.6 Survival. Any provisions of these Terms which by its nature should continue to apply after termination of your use of the Services will survive, including provisions relating to intellectual property, limitation of liability, disclaimers, indemnities, and dispute resolution.
18.7 Governing Law and Jurisdiction. These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Victoria for any disputes arising out of or relating to these terms or your use of our Services, unless otherwise required by law.
18.8 Language. These Terms are drafted in English. If these Terms are translated into another language for your convenience, the English version shall prevail to the extent of any inconsistency.
